Tom C. McCall represents clients in litigation disputes in all matters pertaining to the oil and gas industry, land title, and complex business litigation. Before transitioning to full-time trial and appellate practice in 1979, Mr. McCall was trained as a title attorney by a premier West Texas oil and gas firm in Midland, Texas, and has written hundreds of title opinions, drilling opinions, acquisition opinions, and division order title opinions. Mr. McCall has been continuously Board Certified by the Texas Board of Legal Specialization in Civil Trial Law since 1988. In addition to his decades of trial experience, Mr. McCall has appeared as counsel in numerous appellate proceedings in various Courts of Appeal, the Texas Supreme Court, and the Fifth Circuit Court of Appeals.

Representative Experiences

  • Successfully represented an oil company in challenging the constitionality of the Texas General Land Office Royalty Audit Program, which program was held to be unconsititional in its application.
  • Successfully represented producer in one of the first take-or-pay cases in Texas resulting in a multi-million-dollar verdict and settlement on behalf of the producer.
  • Successfully represented interstate natural gas pipeline in litigation that determined how royalties from split production streams in a pooled unit were to be paid.
  • Successfully represented a historical Texas Gulf Coast Family in litigation based on fraud and breach of contract resulting in a landmark verdict and settlement of behalf of the family. See Texas Monthly article by Cecilia Balli, Return to Padre (2001).
